In a bold move, they are challenging the decision made back in December 2025 to freeze a colossal amount of Russia's sovereign funds – an estimated $300 billion! Most of these assets are held in Europe, particularly within the Belgian depository, Euroclear.

But here's where it gets controversial: The Russian central bank claims this freeze was implemented with 'serious procedural violations.' They argue that the decision wasn't made unanimously, as EU law apparently requires, but rather by a majority vote. This alleged procedural misstep is at the heart of their legal challenge.

And this is the part most people miss: The original EU document that enacted the freeze, published on December 12, 2025, seems to explicitly rule out any possibility of Russia pursuing legal action within EU courts. However, the central bank is undeterred, asserting that the EU regulation infringes upon fundamental rights, including access to justice, the inviolability of property, and the principle of sovereign immunity – rights they believe are guaranteed by international treaties and EU law itself.

Earlier, in December 2025, the central bank had already initiated a lawsuit in Moscow, seeking a staggering $230 billion in damages from Euroclear. This was in response to the indefinite freeze and also to proposed plans to confiscate these assets to fund Ukraine, plans that, as of now, have not come to fruition.
