NASCAR Reaches Settlement in Year-Long Legal Battle with 23XI and Front Row Motorsports

NASCAR and the two teams suing it—Front Row Motorsports and the Michael Jordan–owned 23XI Racing—have settled, a lawyer involved in the case announced in court. The agreement brings an end to the antitrust dispute that had cast a long shadow over the sport and its leadership.

“I’m pleased to say the parties have positively settled this matter in a way that will benefit the industry going forward,” said Jeffrey Kessler, attorney for the plaintiffs.

After a 14-month lawsuit and eight days of courtroom sparring, the settlement ends negotiations over charter arrangements that sparked the conflict. The core issue centered on whether NASCAR’s charter system—an arrangement that functions similarly to franchises and guarantees a measure of revenue—would endure beyond the current seven-year contract through 2031 and the seven-year option that could follow.

A key point throughout talks was ensuring permanent charters. Both 23XI and Front Row likely hope to recover the three charters they lost amid the litigation. The settlement was still being finalized, and the precise terms had not been disclosed publicly.

The case began with a jury trial after a string of high-profile testimonies from NASCAR officials and team owners. Notables on the stand included 23XI co-owners Michael Jordan and Denny Hamlin, along with top NASCAR executives Steve O’Donnell, Steve Phelps, and Jim France.

In the lawsuit, 23XI and Front Row alleged that NASCAR and France engaged in anticompetitive and exclusionary practices designed to enrich the league at the expense of the sport’s premier racing teams.

The dispute followed a contentious charter extension in 2024, when 13 charter-holding teams were presented with an essentially take-it-or-leave-it offer from NASCAR. Several teams signed, but Front Row and 23XI chose not to, setting the stage for the ongoing conflict.

Ownership of a charter—one of 36 available—resembles owning a franchise in other major sports. Charter holders gain financial guarantees and entry to all Cup Series races, with values having surged in recent years—from roughly $2 million to a recent sale price of $45 million. The financial stakes surrounding charters added complexity to settlement discussions.

Industry-wide, the settlement is likely to be welcomed. The antitrust case had dominated headlines and lingered over NASCAR’s Cup Series championship weekend. The trial revealed deep tensions between the parties, including provocative exchanges and strong testimony about the impact of charter agreements on competition.

Judge Kenneth D. Bell had warned of potentially disastrous consequences for the sport if the plaintiffs prevailed, including the possibility of NASCAR being forced to sell racetracks or cede control, or for the charter teams involved to lose their status entirely.

In the weeks leading up to the settlement, top NASCAR executives and team owners participated in a two-day settlement conference. The initial day showed promise, while the second day dampened expectations. Nevertheless, NASCAR moved to settle ahead of the championship weekend, and the parties have now agreed to an end to the protracted litigation.

With legal fees mounting into the eight-figure range for both sides, the sport avoids a potentially catastrophic outcome no matter which way the case had gone. The settlement marks a closing chapter on this dispute and a move toward stability as NASCAR heads toward the next season.
